On June 22, 2000, the D.C. Circuit Court of Appeals lifted its stay of EPA’s NOx SIP Call. The 22 states and the District of Columbia now have until September 1, 2000 to submit their Phase 1 SIPs. The NOx SIP compliance date is May 1, 2003. Several sources within these states are also subject to the requirements specified in 40 CFR Part 97. EPA has stated that it will withdraw the federal requirements for these Part 97 affected sources, provided that the state submits a SIP revision meeting all of the requirements of both phases of the NOx SIP Call.
